Terms of Service

Please read these Terms carefully. They include an arbitration agreement and class-action waiver (Section 16) that affect your legal rights.

Plain-English summary (not a substitute for the full terms): SnapAPrice gives junk-removal businesses an AI tool that estimates jobs from customer photos. Estimates are not binding quotes. If you're a homeowner, the business you contacted — not SnapAPrice — provides the actual service and sets the final price. Disputes are resolved by individual arbitration, and you can opt out within 30 days.

1. Who these terms are between

These Terms of Service ("Terms") are a binding agreement between you and SnapAPrice ("SnapAPrice," "we," "us," or "our"). They govern your access to and use of our website, quote widget, dashboard, APIs, and related services (together, the "Service"). By creating an account, installing our widget, submitting photos for a quote, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Definitions

  • "Client" — a junk-removal or hauling business that creates an account to use the Service on its own website.
  • "End User" — a person (such as a homeowner) who submits photos or contact information through a Client's SnapAPrice widget or quote page.
  • "Estimate" — a non-binding price range generated by the Service from photos and inputs, using the Client's own pricing rules.
  • "Content" — photos, text, contact details, and other material submitted to or through the Service.

3. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Service. Clients are responsible for keeping account credentials secure and for all activity under their account. Notify us immediately at support@snapaprice.com if you suspect unauthorized access. You are responsible for the accuracy of the information you provide, including your pricing rules and business details.

4. The Service, and what an Estimate is (and isn't)

SnapAPrice uses artificial intelligence to assess the scope of a removal job from photos and inputs, then applies the Client's own pricing rules to produce an Estimate. See our AI Disclosure for details.

An Estimate is a preliminary, non-binding price range, not a contract, offer, appraisal, or guarantee of final price. Actual pricing, scheduling, and the removal service itself are provided solely by the Client, who may adjust or decline any Estimate. SnapAPrice is a software provider; it does not haul junk, employ crews, set prices, or become a party to any transaction between a Client and an End User.

5. Client responsibilities

  • You represent that you own or are authorized to operate the website where you install the widget, and that your business is properly licensed and insured for the services you offer.
  • You are solely responsible for your pricing rules and for honoring, adjusting, or declining Estimates with your customers.
  • You are solely responsible for complying with all laws that apply to your communications with End Users, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and state telemarketing and consumer-protection laws. You will obtain and maintain any consent required before contacting End Users, and will honor opt-out requests promptly.
  • You will not use the Service to collect information you are not legally permitted to collect or to contact people who have not engaged your business.

6. End User terms

If you are an End User, you submit photos and contact information voluntarily to receive an Estimate from the Client whose widget you used. You understand that the Client — not SnapAPrice — will contact you, set the final price, and perform any service. By providing your phone number and requesting a quote, you consent to receive text messages related to your request as described in Section 7 and in our Privacy Policy.

7. Text messaging (SMS) terms & your consumer rights

  • By submitting your phone number through a quote form, you agree to receive text messages about your quote and pickup from the Client, sent through SnapAPrice's messaging system. Message frequency varies. Message and data rates may apply.
  • You can opt out at any time by replying STOP to any message. Reply HELP for help. Opting out stops further messages about that request.
  • Consent to receive messages is not a condition of purchasing any goods or services.
  • Carriers are not liable for delayed or undelivered messages. We are not responsible for the content the Client chooses to send within permitted templates.

8. User-generated content & your responsibilities for it

You retain ownership of Content you submit. You grant SnapAPrice a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display that Content solely to operate and improve the Service (for example, to generate an Estimate, deliver the lead to the Client, and provide support). We do not sell your Content.

You represent and warrant that Content you submit:

  • is yours to submit, or you have permission to submit it;
  • does not infringe any copyright, privacy, publicity, or other right, and does not contain material you are not authorized to share;
  • does not depict other people without their consent, and does not contain unlawful, harmful, or offensive material;
  • is accurate and not intended to deceive.

You are solely responsible for the Content you submit. SnapAPrice does not pre-screen Content and is not responsible or liable for Content submitted by Clients or End Users. We may remove Content or suspend accounts that violate these Terms. To report infringing content, see our DMCA / Copyright policy.

9. Acceptable use

You agree not to, and not to help anyone else:

  • access the Service through automated means beyond the provided widget/API, or scrape it;
  • probe, scan, overload, or circumvent security or rate limits, or attempt to gain unauthorized access to any account, system, or data;
  • submit malware, or upload Content you have no right to upload;
  • reverse engineer the Service except to the extent that restriction is prohibited by law;
  • use the Service to violate any law or the rights of others.

10. Fees, billing & the introductory offer

Current pricing is presented at sign-up. Our introductory offer — pay $0 until SnapAPrice books your first 5 jobs, then $199/month — applies as described at the time you accept it and may be changed for future customers. Subscriptions renew monthly until cancelled. You authorize us (or our payment processor) to charge your payment method for applicable fees. Fees are non-refundable except where required by law. You are responsible for applicable taxes. Third-party costs you incur directly (for example, SMS carrier fees) are your responsibility.

11. Intellectual property

The Service, including its software, design, and trademarks, is owned by SnapAPrice and protected by law. We grant Clients a limited, revocable, non-transferable license to use the Service and to embed the widget on websites they control, solely as intended. No other rights are granted.

12. Third-party services

The Service relies on third parties (for example, AI providers, hosting, and SMS carriers). Their availability and terms are outside our control, and we are not responsible for their acts or omissions.

13. Disclaimers

THE SERVICE AND ALL ESTIMATES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ESTIMATES WILL BE ACCURATE, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY LEAD WILL RESULT IN A BOOKED JOB. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPAPRICE AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $100. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. Some jurisdictions do not allow these limits, so they may not fully apply to you.

15. Indemnification

You will defend, indemnify, and hold harmless SnapAPrice from any claims, damages, and expenses (including reasonable legal fees) arising from your Content, your use of the Service, your violation of these Terms, or — for Clients — your communications with or services to End Users, including any TCPA or consumer-protection claim.

16. Dispute resolution — arbitration & class-action waiver

Please read this section carefully; it affects your rights. You and SnapAPrice agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, not in court, except that either party may bring an individual claim in small-claims court. The arbitration will be administered by a recognized arbitration provider under its consumer rules, and may be conducted by phone, video, or written submissions. The arbitrator decides all issues, except that a court decides the enforceability of this section.

Class-action waiver. Disputes will be brought only in an individual capacity. You and SnapAPrice waive any right to bring or participate in a class, collective, or representative action. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court.

30-day opt-out. You may opt out of this arbitration agreement by emailing legal@snapaprice.com with your name, account email, and a statement that you opt out, within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.

This section is governed by the Federal Arbitration Act. It survives termination of your account.

17. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate access for violation of these Terms, suspected abuse, or as needed to protect the Service or others. On termination, your license to use the Service ends; sections that by their nature should survive (including 8, 13–16, and 18) survive.

18. Governing law & venue

Except for the arbitration agreement (governed by the Federal Arbitration Act), these Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Where arbitration does not apply, the state and federal courts located in Michigan have exclusive jurisdiction.

19. Changes to these Terms

We may update these Terms. If we make material changes, we will update the "Last updated" date and, where appropriate, notify Clients. Continued use after changes take effect means you accept the updated Terms.
